Art to help with your tax affairs: how does it work?
Buying a piece of contemporary art is not just an aesthetic choice for your offices; it is also a highly advantageous tax measure. French law encourages cultural patronage by allowing businesses (subject to corporation tax or income tax) to reduce their tax liability.
The 4 key benefits for your business:
100 per cent tax deduction: The purchase price of the artwork is deductible from your taxable income in equal instalments over five years (20 per cent per year).
Immediate tax relief: The deduction is applied in respect of the financial year in which the purchase was made and the following four years.
Enhancing your image: You can enhance the look of your workspaces (reception area, meeting rooms, offices) whilst supporting the creative arts.
No capital gains tax: Works of art are not included in the calculation of business assets subject to any annual taxes.
The three simple conditions to follow:
1.Living artist: The artwork must be purchased directly from a living artist (or via an intermediary such as our gallery) at the time of purchase.
2.Public display: The artwork must be displayed free of charge in a location accessible to the company’s customers, partners or employees (administrative offices or high-traffic areas are ideal).
3.Legal ceiling: The annual deduction must not exceed the ceiling of €20,000 or 0.5 per cent of your company’s annual turnover excluding VAT (whichever is the more favourable).
